CLEUD granted for B1 Offices in residential area, Belfast.

The appeal site is a mid-terrace, 3 storey property located in a residential street at Hughenden Avenue, Belfast.

The Appellant was using the ground and first floor of the property in association with his business, McAuley Freight continuously since May 2007.

The business operating from the premises is totally office based and is part of a wider one that arranges freight transfer by road, rail and sea as well as storage of freight.

The Department were not satisfied that sufficient evidence had been submitted to show that the change of use of the building from residential to offices began at least five years prior to the date of their decision and as a result was not immune from enforcement action.

MKA  Planning submitted evidence to demonstrate that the offices on the ground and first floor have been operational from these premises since 2003.

The Commissioner concluded that the ground and first floor of the property had been used as offices since 2003, was therefore now immune from enforcement and granted the CLEUD certificate.
