This was a challenging project. The Client wanted a dental practice in the rural area outside Cookstown. His wife was operating an ‘un-authorised’ beauty salon at the application site.
MKA indicated that a straightforward application for a dental practice was unlikely to be successful as the application site only had permission for a garden centre.
MKA devised a planning strategy to get the dental practice approved through initially getting a CLUED Certificate for the beauty salon as a Class 1 Retail Use meaning that the premises could be used as a retail shop in the countryside.
An application was then submitted for the dental practice arguing that this community facility was more appropriate in the rural area and represented a planning gain and also got rid of the lawful retail shop. Planning Service accepted the MKA planning logic and granted permission.
