NEIGHBOUR NOTIFICATIONS: AGENTS/ DEVELOPERS BEWARE.
Since 1st April 2015 when the Planning (General Development Procedure ) Order 2015 came into operation Article 8 (1)(b) now requires identified occupiers of neighbouring land to be served notice of thee application and they are permitted 14 days from the date stipulated on the notice to comment on the proposal if they so wish.
As this is now a statutory requirement for obtaining planning permission failure to properly neighbour notify all notifiable neighbours by either the Applicant or the Council may potentially invalidate any planning permission or leave it open to a legal challenge.
