Ballymoney couple fined a total of £30,000 for planning offence

The Ballymoney couple were each fined £15,000 at Coleraine Magistrates Court today. They were found guilty to a continued non compliance with a DOE Planning Enforcement Notice and were also made to pay a total of £500 legal costs and a total of £85 court costs. They were charged with the unauthorised erection of a partially constructed cattle shed and underground dirty water storage tank / slurry tank at their property and were prosecuted under Article 72 of the Planning (Northern Ireland) Order 1991. If served with an Enforcement Notice one should seek professional planning advice immediately.  Regardless, you must either appeal the Notice or comply with its requirements within the specified period, otherwise you have committed a criminal offence. 

In this case, the Notice was not appealed and this was the second time the couple had come in front of the Court without complying with the Notice resulting in a substantial fine to ensure compliance.
