Planning Approval for TLC Beauty Clinic in Newbuildings Industrial Estate

The Applicant had been subject to enforcement proceedings by Planning Service who required vacation of the premises.

The original planning permission for the Business Park granted under DOE ref: A/2002/0792/F stipulated at condition No. 3 that –

Only Light (Class 4) and General (Class 5) Industrial Uses may be operated from the site.

 

 

Despite this condition, the beauty salon had been operating successfully from the premises for almost 4 years. MKA Planning raised a number of material planning considerations that supported the approval of the retention of the beauty salon within the industrial estate, namely: –

  1. The beauty salon was compatible with the existing uses within the Ballyore Business. This use met a local need in the village of Newbuildings.
  2. MKA contended that Class A1 Retail is generally accepted as compatible neighbours with light industrial uses.
  3. The application site could not be considered to be a vital local industrial land resource due to the surplus of available industrial land within the Derry area.

MKA Planning were successful in securing the full planning permission for the removal of a planning condition which allowed for the retention of a beauty salon within Ballyore Business Park, an industrial estate at Newbuildings.
